Breakfast with Hugh Jackman in New York City Competition Terms and Conditions
- The Promoter
AVAAL 4 Life Foundation Ltd ABN: 82 618 093 762, 2 / 3 Apollo Street, Warriewood NSW 2102, in association with Chemist Warehouse Group (Chemist Warehouse Pty Ltd, My Chemist and My Beauty Spot group).
- Terms of Entry
(a) Competition entries can be made from 9.00am AEST on 9th June 2017 until midnight AEST on 7th July 2017 through the following websites: www.avaal4life.org, www.gotch4life.org/hughinnewyork and www.chemistwarehouse.com.au.
Entries received outside the Competition period will not be eligible or accepted. (b) Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void. (c) Entry is conditional upon entrants holding a fully paid online ticket. (d) The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused. (e) Submitting an entry constitutes acceptance of these terms and conditions. (f) Multiple entries by eligible entrants are accepted. (g) Once your entry is submitted, it cannot be amended.
- Who May Enter
(a) The Competition is only open to Australian permanent residents, aged 18 years or over. (b) The Competition is not open to:
- Employees of the Promoter;
- Parties to whom the Promoter has contracted work in relation to this Competition;
- Parties who are otherwise directly involved with this Competition; and
- Any immediate family members or any of the above mentioned parties.
(a) The prize is:
- 2 return economy airfares to New York from an Australian capital city.
- 4 Nights Accommodation in New York City staying at Novotel Hotel Times Square (or equivalent)
- 2 Tickets to a show in New York (to be determined by the promoters, based on ticket availability)
- Breakfast with Hugh Jackman in New York on Sunday Oct 1 (date may be subject to change depending on Hugh’s committments) . Further details will be provided closer to the event
(b) The prize awarded by the Promoter is non-transferable and cannot be exchanged for any valuable consideration, in particular, for money. Any attempt to sell the prize or attempt to exchange the prize for valuable consideration, will result in the cancellation of the prize. The Promoter has the sole and absolute discretion to decide such matters. (c) Airline tickets, Theatre tickets and hotel accommodation will be arranged by the Promoter and the prize winners will be expected to be available in NY on the morning of Oct 1. (d) The prize does not include any airport transfers, cab fares or spending money. (e) All other living costs including meals and transport are at the winner’s personal expense.
- Selecting the Winners
(a) The Competition winner will be selected on Friday 14th July 2017
(b) This is a game of skill. The Competition winner will be selected using a computer algorithm to produce a top 10 list of stories. If any of the top 10 stories has multiple entries with the same exact story, the earliest entry submission will be selected to be in the top 10. The final 10 will be reviewed by the AVAAL 4 Life Foundation Ltd Advisory Board and a winner chosen.
(c) The Competition winner will be notified by email by 5.00pm on 14th July 2017. If an entrant does not confirm receipt of the notification and acceptance of the prize by 5.00pm on Monday 17th July 2017, the entrant may forfeit their prize and the Promoter may award a prize to the next best entrant on 18th July 2017. Whilst the Promoter will use its best endeavours to contact the winner within the above mentioned time, the decision not to award an entrant who cannot be contacted a prize is at the sole and absolute discretion of the Promoter, and can be made at any time after the Competition winner has been selected.
(d) A person purporting to be a prize winner may be required to provide proof of identity and to verify any other eligibility requirements.
(e) The Promoter reserves the right to perform a character reference check, including a criminal reference check, on the winner of the competition and their guest (i.e. the 2 people taking the trip) in order to verify the winner poses no threat to the organisers and the parties involved in the fulfillment of the prize. The Promoter, may at its sole discretion, select another winner, if the previous winner (and guest) are deemed to pose a threat to the organisers and parties involved.
- Publication of winner’s details
The Promoter will publish the Competition winner’s name in the following sites on 18th July 2017 and that information shall remain posted there for at least 28 days: www.avaal4life.org, www.gotch4life.org/hughinnewyork and www.chemistwarehouse.com.au.

- Privacy and use of personal information
(a) In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of personal information about entrants, such as their name, and email address. This is collected for the purpose of establishing eligibility, carrying out the Competition and notifying winners. If the information is not provided, the entrant may not participate in the Competition. Entrants’ personal information may be disclosed to Government Agencies if required under legislation.
(b) Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.
(c) Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of this Competition.
- Discontinuation of the Competition or Disqualification of an Entrant
(a) Subject to State legislation; The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the Competition.
- Exclusion of Liability
(a) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.
(b) The Promoter is not responsible for any losses associated with any change to the value of any prizes.
(c) To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any person or to personal property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter or its servants or agents, in connection with the arrangements for the supply of any goods or services by any person to the prize winner and where applicable, to any person or persons accompanying the prize winner.
(d) The Promoter’s decision on all matters relating to this Competition will be final.
(e) The Promoter is under no obligation to provide reasons for any of its decisions.
(f) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.
- Donation Receipt
The entrant should speak with their accountant for any tax treatment on the cost of entering the competition. The Promoter does not put forward the competition entry cost is a tax deductible donation.
